Judge dismisses sofa damage claim after being furnished with technical examiner’s report
A SOFA on which the ten year warranty expires in December was the subject of a Small Claims suit at Navan District Civil Court.
The action was taken against Moran's Homezone Ltd trading as 1933 Furniture Company, Beechmount Homepark, Navan.
The claimant with an address in Stillorgan told Judge Eirinn McKiernan at last Friday’s sitting of the court that she bought the sofa ten years ago this December.
Her claim in the amount of €170 was in respect of the frame inside the sofa that broke. There was a ten year warranty on the sofa. When she approached the company it wouldn’t honour the warranty.
A company representative said an independent technician examined and prepared a report. He found no manufacturing fault, and the issue probably resulted from accidental damage within the home.
The plaintiff maintained it was not accidental damage.
Judge McKiernan said she had to rely on the on the independent report provided to the court. She couldn’t do anything about the claim and dismissed it.
