Banned from driving after Kentstown accident

A 43 year-old man, Barry James McGrath with addresses at Laganara View, Kentstown, and Swords, was banned from driving for four years resulting from a road accident over three years ago.

The defendant faced charges of driving while under the influence of an intoxicant and dangerous driving after a two vehicle collision on the R153 at Burtonstown, Kentstown, on 12th September 2022.

He received a two year driving ban in respect of the dangerous driving count and was fined €200 and banned from holding a driving licence for four years on the intoxication charge.

Trim District Court heard that that the defendant was overtaking when the collision occurred. The lady driver in the other vehicle was turning, and there was a single continuous white line at the location.

Garda Linzi Martin who came across the accident described that the defendant was dishevelled, noting his shoes were on the wrong feet and trousers inside out. She also noted his speech was slurred.

The defendant provided a specimen of blood, for which the result of the analysis was zero for alcohol. The defendant said that he was on prescribed medication for anxiety which wouldn’t affect his driving. Judge Eirinn McKiernan said the defendant was given the opportunity to obtain medical records, but two months later he hadn’t obtained them. She convicted him on the evidence before the court. She fixed bail for the defendant to appeal.
